Terms of Service

These terms govern your use of Arbrik, the renovation marketplace at app.arbrik.com and in the Arbrik mobile app. By creating an account or using the service you agree to them. Please read them: they explain that Arbrik is a platform and an escrow service, not the builder, and how money, fees and disputes work.

1. Who we are and what Arbrik is

Arbrik (“Arbrik”, “we”, “us”) is operated by AusRenoGuides, Australia. Arbrik lets homeowners describe a renovation project, lets verified tradespeople (“tradies”) quote on it, and holds the homeowner’s payment in escrow to be released as milestones are completed.

Arbrik is not a party to the renovation contract. When a homeowner accepts a tradie’s quote, the contract for the work is between the homeowner and the tradie. Arbrik is not a builder, contractor, licensee, employer, agent or insurer of either party, does not supervise the work, and does not guarantee its quality, timeliness or compliance. We provide the marketplace, the tools and the escrow.

2. Eligibility and accounts

  • You must be at least 18 and able to enter binding contracts under Australian law.
  • You must give accurate, current information and keep it updated. One account per person or business; a person may hold a homeowner role and a tradie role on the same account.
  • You are responsible for everything done under your account. Keep your sign-in secure and tell us at once if you suspect misuse.
  • We may suspend or close an account that breaches these terms, appears fraudulent, or puts other users at risk.

3. Homeowners

  • You confirm you own the property or are authorised by the owner to arrange the work and to share photos of it.
  • Describe the project honestly. Tradies quote on what you tell them; material omissions can void a quote or a milestone.
  • You are responsible for any approvals the work needs (council, strata, insurer), unless you and the tradie agree otherwise in the quote.
  • For insurance-restoration projects, you are responsible for the accuracy of the claim details you enter and for your obligations to your insurer.

4. Tradies

  • You must hold, and keep current, every licence, registration and insurance that the law of the relevant state or territory requires for the work you quote on, and you must comply with the building, consumer and safety laws that apply to it (for example state home-building legislation and its written-contract requirements for larger jobs).
  • You must have a valid ABN and quote with your correct GST status. Verification badges are based on the information you provide and the checks we run; they are not a warranty by Arbrik.
  • Your quotes must be genuine, complete and priced as you intend to perform them. A quote accepted through Arbrik binds you to its terms.
  • You must complete a Stripe Connect account to receive payouts. Stripe's own terms apply to that account.
  • No fee circumvention: you must not take a job you found through Arbrik, or a subsequent job with the same homeowner within 12 months, off the platform to avoid the platform fee.

5. Quotes, acceptance and the contract

A quote submitted on Arbrik is an offer by the tradie. When the homeowner accepts it on the platform, a contract for the work is formed between them on the terms of the quote, the project description and the milestone schedule. Where the law requires a separate written contract or additional disclosures (as some states do above a value threshold), the parties must complete those themselves; Arbrik’s records are a convenience, not a substitute.

Either party may withdraw before acceptance. After acceptance, changes to scope or price should be agreed in writing between the parties (the in-app chat is fine) before the affected milestone is released.

6. Escrow and payments

Funding

The homeowner funds the accepted contract through Stripe. Funds are held in escrow for that project and shown as a milestone schedule (a deposit, stages of work, practical completion and a warranty holdback by default). Arbrik does not hold client money in its own bank account; funds sit with Stripe, a regulated payment provider.

Release

A tradie marks a milestone ready; the homeowner reviews and releases it. On release, the milestone amount less Arbrik’s platform fee is transferred to the tradie’s Stripe account. The homeowner should release promptly once the milestone’s condition is met and should raise a dispute (section 8) rather than simply withhold.

Payout timing

Released funds remain on the tradie’s Stripe balance for a hold period of 7 days, which is the window in which a dispute about that release can still be resolved by reversal, after which Arbrik pays them to the tradie’s nominated bank account. Bank processing may add one to three business days.

Refunds and chargebacks

Refunds to the homeowner are made through the dispute process or by agreement of the parties. Initiating a card chargeback for a payment that is the subject of an open Arbrik dispute is a breach of these terms and may result in account closure.

7. Fees

  • Homeowners pay no platform fee.
  • Tradies pay a platform fee on each released milestone: 8% on the Free tier, 4% on the Pro tier. The fee is deducted at release; nothing is charged for browsing, claiming leads or submitting quotes.
  • Arbrik Pro is a subscription of $79 per month, billed through Stripe, with a free trial where offered. You can cancel at any time from the billing portal; the subscription runs to the end of the paid period and the fee rate reverts to 8% after that.
  • Promotional coupons, referral rewards and founder-cohort offers are subject to the conditions shown when they are issued and may be withdrawn for future jobs at any time.
  • All amounts are in Australian dollars. Where GST applies to a fee, it is included in the stated amount and shown on the tax invoice.

8. Milestone disputes

If the parties disagree about whether a milestone has been earned, the homeowner may raise a dispute on that milestone before it is released. The funds for that milestone are then held. The tradie is invited to respond with evidence (photos, messages, documents). Arbrik reviews the record and decides whether the held amount is released to the tradie, refunded to the homeowner, or split.

  • Arbrik's decision concerns only the money held in escrow for that milestone. It is not a determination of the parties' legal rights, and it does not prevent either party from pursuing remedies through the relevant state tribunal (such as NCAT, VCAT or QCAT), a court, or a building-dispute or fair-trading body.
  • Both parties must act in good faith, respond within the time the process allows, and provide truthful evidence.
  • We may contact either party, review chat messages and photos on the project, and ask for further information.

9. AI-generated content

Arbrik offers AI-assisted tools: a draft scope of works from photos, an analysis of the quotes on a project, and a draft waste-management plan. Their output is a starting point, not advice. It can be incomplete or wrong. You are responsible for checking it against a qualified tradie’s assessment and the requirements of your council, state or insurer before relying on it. Arbrik accepts no liability for decisions made on the basis of AI output alone.

10. Your content

  • You keep ownership of the photos, descriptions, quotes and messages you post. You grant Arbrik a non-exclusive, worldwide, royalty-free licence to host, store, display and transmit them as needed to run the service and resolve disputes.
  • You confirm you have the rights to post the content and that it does not infringe anyone's rights, breach any law, or include other people's personal information without their consent.
  • We may remove content that breaches these terms or the law.

11. Acceptable use

You must not:

  • harass, threaten, deceive or discriminate against another user;
  • post false quotes, false project details or fake reviews or badges;
  • use the platform to circumvent fees, to solicit users for another service, or to send unsolicited marketing;
  • scrape, crawl, reverse engineer, overload or interfere with the service, or attempt to access accounts or data you are not authorised to access;
  • use the salvaged-materials marketplace to sell anything you are not entitled to sell, or anything unsafe or unlawful.

12. Salvaged materials marketplace

Listings for reusable materials are made by users. Arbrik is not the seller, does not inspect items and gives no warranty about their condition, safety or suitability. Any transaction is between the listing user and the interested user.

13. Intellectual property

The Arbrik name, logo, software, design and content (other than user content) belong to us or our licensors. You may use the service for its intended purpose and may not copy, modify, distribute or create derivative works from it.

14. Availability and changes

We aim to keep Arbrik available but do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features, and we may update these terms; material changes will be notified in the app or by email before they take effect. Continued use after that date is acceptance of the new terms.

15. Consumer guarantees and liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot be excluded. To the extent the law allows, our liability for a breach of a non-excludable guarantee is limited, at our option, to resupplying the service or paying the cost of resupply.

Subject to that: Arbrik is not liable for the acts, omissions, work, materials or conduct of any homeowner or tradie; for loss arising from the renovation contract between them; for decisions made in reliance on AI output; or for indirect or consequential loss. Our total liability to you in connection with the service in any 12-month period is limited to the platform fees and subscription fees you paid us in that period. You indemnify us against claims arising from your breach of these terms or of the law.

16. Ending your account

You can close your account at any time by contacting us. Open escrow, unpaid fees, active disputes and record-keeping obligations survive closure until they are resolved or expire. We may close accounts as described in section 2.

17. Governing law

These terms are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia, without limiting any right to bring a consumer or building dispute before the tribunal of the state or territory where the work was done.
